Welcome to ARQUIBYTE. By using our services, you agree to the following terms and conditions. Please read them carefully.
1. Introduction
ARQUIBYTE is a remote-work company specializing in providing high-quality design and CAD drafting services to professionals and construction businesses across the United States.
ARQUIBYTE does not seal or sign plans, participate in construction permits, or conduct any on-site involvement or physical interactions. All drafting work is conducted remotely.
By accepting our service proposals, you agree to these terms.
2. Responsibilities of the Parties
2.1. Service Proposal
- Scope of Work: Described in the Service Proposal, detailing what is included and excluded.
- Revisions: The Service Proposal specifies the number of allowed revisions based on project size and complexity.
- Approval and Commencement: CLIENT must confirm and approve the Service Proposal via email to start the work.
- Turnaround Time: Estimated from the approval date to the delivery of the first version.
2.2. Communication and Input Information
- Communication Methods: Primarily via email at [email protected]; large files via Google Drive or Dropbox.
- Timely Communication: Essential for successful completion.
- Information Provision: CLIENT must provide clear, concise, and organized information promptly. All communications and document exchanges are conducted electronically. ARQUIBYTE will not be responsible for misunderstandings or errors resulting from incorrect or incomplete information provided by the CLIENT.
2.3. Engineering and Regulations
ARQUIBYTE adheres to the International Building Code and the International Residential Code. CLIENT must communicate any local jurisdiction requirements. It is the responsibility of local licensed professionals to ensure that all plans meet local jurisdictional codes and regulations.
2.4. Costs and Payment Terms
- Service Cost: As described in the Service Proposal.
- Invoice Submission: Via email to the CLIENT’s provided address.
- Payment Mechanisms: PayPal, Zelle, or ACH transfers.
- Payment Schedule:
- Up to $500: Paid in full.
- Up to $3,000: Two equal installments.
- Over $3,000: Multiple installments as agreed in writing.
- Payment Delays: CLIENT agrees not to delay payment due to third parties involved in the project.
- Late Payment Fee: $50 for late payments after 30 days past due invoice, with a cumulative monthly increment of $10.
2.5. Final files
ARQUIBYTE will release the files once all invoices are fully paid. Only previews are provided while invoices remain unpaid.
2.6. Term and Termination
ARQUIBYTE’s responsibilities commence on the service approval date and terminate upon completion of the tasks outlined in the Scope of Work. If no feedback or revisions are received within 30 days after presenting the work, the terms are considered complete. CLIENT’s responsibilities will end when all invoices are fully paid.
2.7. Client Responsibilities
The CLIENT is responsible for coordinating with local professionals to ensure that all necessary permits, approvals, and stamps are obtained. ARQUIBYTE will not be held liable for any delays or issues arising from permit processing or compliance with local regulations.
2.8. No Physical Site Inspection
As ARQUIBYTE operates remotely, no site inspections or physical assessments are conducted. All information provided by ARQUIBYTE is based on the data and instructions supplied by the CLIENT.
2.9. Legal Compliance
ARQUIBYTE operates remotely from outside the USA and ensures compliance with applicable U.S. regulations and standards as far as remote CAD drafting is concerned. It is the responsibility of local licensed professionals to ensure that all plans meet local jurisdictional codes and regulations.
2.10. Accuracy and Liability
While ARQUIBYTE strives to provide accurate and high-quality drafting services, it does not assume any liability for errors or omissions in the plans once they are used for permit applications, construction, or any other purpose. The accuracy of all plans and their compliance with local building codes and regulations is the sole responsibility of the licensed professionals involved.
3. Relationship Among the Parties
3.1. Relation of the Parties
ARQUIBYTE operates as an independent contractor. These terms do not create any employment, partnership, joint venture, or agency relationship.
3.2. Modification of these Terms
Provisions can be modified upon mutual written consent.
3.3. Ownership of Intellectual Property
ARQUIBYTE assigns all intellectual property rights created under these terms to CLIENT but retains the right to showcase the work for promotional purposes.
3.4. Confidential Information
Both parties must keep confidential information private, extending one year after termination of these terms.
4. Privacy Policy
Your privacy is important to us. ARQUIBYTE collects and uses personal information solely for providing and improving our services. We do not share your personal information with third parties without your consent, except as required by law.
- Data Collection: We collect information you provide, such as your name, email address, and project details.
- Data Usage: The information is used to deliver our services, process payments, and communicate with you.
- Data Security: We implement reasonable security measures to protect your personal information from unauthorized access, disclosure, or misuse.
- Data Retention: We retain your personal information only as long as necessary to fulfill the purposes for which it was collected and to comply with legal obligations.
5. User Conduct
By using our services, you agree to:
- Provide Accurate Information: Ensure all information provided to ARQUIBYTE is accurate, complete, and up-to-date.
- Respect Intellectual Property: Do not use ARQUIBYTE’s services to infringe on the intellectual property rights of others.
- Use Services Legally: Comply with all applicable laws and regulations when using ARQUIBYTE’s services.
- Communicate Professionally: Maintain professional and respectful communication with ARQUIBYTE’s team and representatives.
6. Dispute Resolution
In the event of any dispute arising out of or in connection with these terms, the parties agree to:
- Good Faith Negotiation: Attempt to resolve the dispute through good faith negotiation.
- Mediation: If negotiation fails, the parties agree to attempt to resolve the dispute through mediation before resorting to any other dispute resolution procedures.
7. Miscellaneous
7.1. Construction
If any provision is held invalid, the remaining provisions remain effective.
7.2. Counterparts; Facsimile Copies
Digital and electronic copies of these terms are accepted as originals.
7.3. Limitation of Liability
These terms constitute the entire understanding between the parties. Neither party is liable for special, indirect, incidental, or consequential damages.
